Terms of Service

1. Agreement to Terms

By accessing or using Contito, you agree to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

If you disagree with any part of the terms, you are prohibited from using or accessing the service.

2. Use License

You are granted a revocable, non-exclusive and non-transferable limited license to use Contito's application to build websites for personal, commercial and non-commercial purposes.

Under this license -

You may:

• Create and host a website for your commercial or non-commercial project
• Create and host a website for your clients' commercial or non-commercial projects
• Provide your own custom domain name for you or your clients' websites
• Provide your own images, contents and other assets for your websites

You may not:

• Create and/or host the following type of websites:
• Adult content
• Hate speech
• Violence
• Illegal content
• Infringement of intellectual property rights
• Phishing websites or those that contain malicious code
• Resell or redistribute any parts of any components and templates
• Manually or programmatically download generated code (HTML, CSS and JS) produced by Contito for personal, educative, commercial and non-commercial use
• Use abusive or obscene words for website subdomains and custom domains
• Inject malware or JS-mining software in a built website
• Upload forbidden documents, images or any other files forbidden by the laws
• Remove any copyright or other proprietary notations through custom code
• Make any editions or modifications to the application code

Should you violate any of these terms, we may terminate your access to your websites or account without prior notice.

By using our service, we reserve the right to showcase your websites in our promotional materials, such as on our website, social media, and other promotional channels, without your consent in advance.

3. Subscription Plan

Contito charges your account based on one of the 3 different plans: Starter, Pro and Ultimate.

• A website requires a paid subscription plan to remain active and accessible for everyone via a unique subdomain or domain name
• A plan is billed and renewed automatically every month or every year after the date of purchase
• When you upgrade to a higher-priced plan, the change takes effect immediately and you are charged a prorated amount for the remainder of your current billing cycle
• When you downgrade to a lower-priced plan, you keep your current plan and its features until the end of your current billing cycle, after which the new plan takes effect; no credit or refund is issued for the change
• Switching between monthly and yearly billing follows the same rules: moving to yearly billing takes effect immediately with a prorated charge, while moving to monthly billing takes effect at the end of your current billing cycle
• You can cancel your subscription plan anytime in the Plan Settings page
• If we fail to renew your subscription plan because of failed payment, we may expire your plan immediately without prior notice
• If your account's subscription plan is expired, you will need to subscribe to a new plan to continue using it

4. Plan Limits and Paused Websites

Each plan includes a limit on how many websites you can keep active and how much content each website can hold. The Starter plan includes 1 website with up to 25 contents. The Pro plan includes 5 websites with up to 100 contents each. The Ultimate plan includes 15 websites with unlimited content.

Content limits apply per website. If a website reaches your plan's content limit, you will not be able to add or sync new content to that website until you delete enough content to return under the limit. The website itself remains online while you do so.

If you downgrade to a plan that allows fewer active websites than you currently have, the following applies:

• When the downgrade takes effect, you will be asked to choose which websites to keep active, up to your new plan's limit
• You have 10 days from that date to make your choice
• If you do not choose within 10 days, we will automatically keep your most recently updated websites active up to your new plan's limit and pause the remaining websites

A paused website is taken offline and displays a "site paused" notice instead of your content, and becomes read-only — you cannot add or edit its content or sync new changes to it. Its content is retained and the website is never deleted by us. You can bring a paused website back online at any time by upgrading your plan, or by deleting or leaving other active websites to make room within your limit.

If your subscription expires, is canceled and not renewed, or fails to renew due to a failed payment, all of your websites are paused in the same way until you subscribe to an active paid plan again.

5. Free Beta

While Contito is in beta, you can use our service for free with access to all the features in the Pro plan.

• No credit card is required during the beta
• We may end the beta at any time. Once it has ended, you will need to add a paid subscription plan to continue using the service
• Failure to subscribe to a paid plan after the beta has ended will result in your website becoming publicly inaccessible, and you will not be able to add any content or make any changes (except for deleting the website)

6. Account and Service Termination

We reserve the right to terminate your access to your websites or account at any time if you:

• Violate the license terms
• Engage in abusive or harmful behavior
• Fail to pay applicable fees

We will not be liable to you or any third-party for any termination of your access to the service.

7. Personal Information

Your submission of personal information through the website is governed by our Privacy Policy.

8. Refund Policy

We will issue a refund if there is a technical problem with the product and we can't help you to resolve the problem. However, all purchases are non-refundable.

9. Cancellation Policy

You can cancel your subscription at any time in your account's Plan Settings page. Once canceled, your subscription will end immediately, but your plan will not expire until the end of the current billing cycle.

After your plan expires, your websites remain online for a grace period of 10 days, during which you can reactivate your subscription and have everything restored as it was. If you do not reactivate within this period, all of your websites are paused until you subscribe to an active paid plan again.

10. Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

In no event shall Contito or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Contito's website, even if Contito or a Contito authorized representative has been notified orally or in writing of the possibility of such damage.

11. Changes To Terms

We reserve the right to modify these terms at any time. We will notify you of any material changes via email or through the Contito's website.
